Wareham District Court – The officer testified he stopped the client for pulling out in front of him and failing to yield, swerving from side to side, mostly with his lane, except for once crossing over the white fog line and stopping in the middle of the road before turning down a dead end road. The officer stated the client smelled of alcohol, had wet, bloodshot and glassy eyes and slurred speech and admitted drinking “just a couple of drinks at dinner a long time ago.” The officer testified the client could not complete the one leg stand field sobriety test and failed the walk and turn field sobriety test. – NOT GUILTY

Plymouth District Court – The officer testified he was dispatched for a report of a loud crash and on arrival, saw the client's car pressed up against a stone wall with severe front end damage and the driver's side door was open with no one inside. The officer stated he saw the client lying down on a residential front lawn without shoes or socks and when asked, stated with very slurred speech that he was the operator, was alone and was not sure if he was hurt. The officer testified the client was very unsteady on his feet and when asked to sit due to being unsteady, he would squat down causing him to fall backwards on several occasions. The officer stated the client had severely slurred speech and a reddish and flush face and eyes and smelled strongly of alcohol. – NOT GUILTY
