Penalties for a Fifth Offense (Felony)

The penalties increase dramatically for a fifth OUI offense. The minimum sentence you will receive is 2 years mandatory in jail, but the range is from 2 ½ years in jail to 5 years in a state prison.

The license loss increases to lifetime.

Fines for a third offense are quite stiff with a minimum of $2,000 and a maximum of $50,000.
